2. Do I have to go to court for a car accident lawsuit? Not necessarily. Most personal injury cases settle without going to court. However, if the insurance company refuses to offer a fair settlement, filing a lawsuit may be necessary. Our attorney prepares every case as if it’s going to trial, to maximize your leverage during negotiations.
3. What should I do immediately after a car accident in South Carolina? First, call 911 and seek medical attention, even if injuries seem minor. Then, document the scene with photos, exchange insurance information, and get a copy of the police report. Do not admit fault. 4. How long do I have to file a personal injury claim in South Carolina? South Carolina’s statute of limitations for personal injury claims is three years from the date of the accident (SC Code § 15-3-530).
